1. Acceptance of Terms
By accessing or using the ProductBot platform ("Service") operated by Zee Solution LLC ("we," "us," or "our") at chatbot.zeesolution.net and related subdomains, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.
2. Description of Service
ProductBot is a cloud-hosted product recommendation chatbot platform that allows businesses ("Subscribers") to create, configure, and embed interactive chatbots on their websites. The Service includes:
- A web-based dashboard for chatbot configuration and analytics
- An embeddable widget that displays on Subscriber websites
- Hosting, maintenance, and delivery of the chatbot service
3. Eligibility
You must be at least 18 years old and have the legal authority to enter into a binding agreement to use this Service. By signing up, you represent that you meet these requirements.
4. Account Registration
- You must provide a valid email address and create a secure password.
- You are responsible for maintaining the confidentiality of your login credentials.
- You are responsible for all activity that occurs under your account.
- You must notify us immediately of any unauthorized use of your account.
5. Subscription Plans and Billing
- Free Trial: New accounts receive a 14-day free trial. No credit card is required to start.
- Paid Plans: After the trial, you may subscribe to a Starter ($29/mo), Professional ($79/mo), or Enterprise ($199/mo) plan. Prices are subject to change with 30 days' notice.
- Billing: Subscriptions are billed monthly or annually via Stripe. By subscribing, you authorize recurring charges to your payment method.
- Cancellation: You may cancel your subscription at any time through the dashboard billing page or Stripe Customer Portal. Access continues until the end of the current billing period. No partial refunds are issued for unused time within a billing period.
- Refunds: We offer a full refund within 7 days of your first paid subscription if you are not satisfied. After 7 days, no refunds are provided.
6. Acceptable Use
You agree not to use the Service to:
- Violate any applicable law or regulation
- Distribute harmful, offensive, abusive, or misleading content
- Attempt to gain unauthorized access to the Service or its infrastructure
- Interfere with or disrupt the Service for other users
- Use the chatbot to collect personal data from end-users without proper consent and disclosure
- Resell or redistribute the Service without our written permission
- Upload malicious code, scripts, or content designed to exploit the platform
7. User Content and Data
- Your Content: You retain ownership of all product data, configurations, and content you upload to the Service ("Your Content"). You grant us a limited license to host, display, and deliver Your Content solely to operate the Service.
- Responsibility: You are solely responsible for the accuracy, legality, and appropriateness of Your Content.
- Backup: While we maintain backups, we recommend you keep your own copies of important content. We are not liable for data loss.
8. End-User Data Processing
When your website visitors ("End-Users") interact with your embedded chatbot:
- We process conversation interactions (button clicks, category selections) to deliver the chatbot service and track usage metrics.
- We do not collect personally identifiable information (PII) from End-Users through the standard product recommendation widget.
- You are responsible for disclosing the use of the ProductBot widget on your website in your own privacy policy.
- You are the data controller for any data collected on your website; we act as a data processor on your behalf for widget interactions.
9. Intellectual Property
- The Service, including its software, design, logos, and documentation, is the property of Zee Solution LLC and is protected by copyright and intellectual property laws.
- Your subscription grants you a non-exclusive, non-transferable, revocable license to use the Service for your business purposes.
- You may not copy, modify, reverse-engineer, or create derivative works based on the Service.
10. Service Availability
- We strive to maintain 99.9% uptime but do not guarantee uninterrupted service.
- We may perform scheduled maintenance with reasonable advance notice.
- We are not liable for downtime caused by third-party services (hosting providers, payment processors, etc.).
11. Limitation of Liability
To the maximum extent permitted by law, Zee Solution LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, or business opportunities, arising from your use of or inability to use the Service.
Our total liability for any claim arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
12. Indemnification
You agree to indemnify and hold harmless Zee Solution LLC, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.
13. Termination
- We may suspend or terminate your account if you violate these Terms or engage in activity that harms the Service or other users.
- Upon termination, your access to the Service will cease and your embedded widgets will stop functioning.
- You may request deletion of your account and data at any time by contacting us.
14. Modifications to Terms
We reserve the right to modify these Terms at any time. Material changes will be communicated via email or a notice on the dashboard at least 30 days before taking effect. Continued use of the Service after changes constitutes acceptance of the updated Terms.
15. Governing Law and Disputes
These Terms are governed by the laws of the State of California, United States. Any disputes shall be resolved through binding arbitration in San Mateo County, California, in accordance with the rules of the American Arbitration Association.
